Terms of Service

1. Acceptance of Terms

By accessing or using OutfitGen (the “Service”) at outfitgen.ai, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Service.

2. Description of Service

OutfitGen provides AI-powered image editing tools that allow users to modify photos, including changing outfit appearances, backgrounds, and artistic styles. The Service uses third-party AI models to generate modified images.

3. User Responsibilities & Prohibited Uses

By using OutfitGen, you agree to the following:

  • Rights to uploads: You confirm that you have all necessary rights, permissions, and consents to upload and process any images you submit to the Service.
  • No harassment or harm: You will not use the Service to create, distribute, or promote content that harasses, bullies, threatens, or harms any individual or group.
  • No Non-Consensual Intimate Imagery (NCII): You are strictly prohibited from using the Service to generate, distribute, or attempt to generate any non-consensual intimate or sexual imagery of any person. This includes “deepfake” or AI-generated content depicting real people without their explicit consent.
  • No illegal use: You will not use the Service for any purpose that violates applicable laws or regulations, including privacy laws, copyright laws, or laws prohibiting obscene or harmful content.
  • No impersonation: You will not create content designed to deceive others into believing that AI-generated images are authentic photographs of real events.
  • No NSFW content involving minors: Any sexual or otherwise exploitative content involving minors is strictly prohibited and will be reported to appropriate authorities.
  • Age requirement: You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.

4. Content Moderation & Termination

OutfitGen reserves the right to review, remove, or disable access to any content that violates these Terms. We also reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any violation of these Terms, including but not limited to violations of Section 3 above.

We employ automated content filtering (via our AI model provider) to detect and block prohibited content. However, we are not responsible for content that evades these filters.

5. AI-Generated Content Disclaimer

AI-generated images produced by the Service are not guaranteed to be accurate, realistic, or suitable for any particular purpose. AI-generated images may not accurately represent real people, clothing items, or scenes. OutfitGen is not responsible for any decisions made based on AI-generated content.

6. Intellectual Property

You retain ownership of images you upload. By uploading images, you grant OutfitGen a limited, non-exclusive license to process your images solely for the purpose of providing the Service. Images are not stored permanently and are not used to train AI models.

Regarding AI-generated output: to the extent permitted by law, we assign any rights in AI-generated images to you, the user who generated them, subject to your compliance with these Terms.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUTFITGEN AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUTFITGEN'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED DOLLARS ($100 USD).

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Reporting Violations

If you encounter any content that violates these Terms, please use the report flag icon on the generated image or contact us at: legal@outfitgen.ai

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the “Last updated” date at the top of this page. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
